                            LISTA DE TARIFE

pentru lucrările efectuate de Biroul Român de Metrologie Legală în cadrul exercitării controlului metrologic legal al mijloacelor de măsurare şi măsurărilor, LT-2009

 

    1. Lista de tarife LT-2009 stabileşte, în conformitate cu prevederile art. 35 din Ordonanţa Guvernului nr. 20/1992 privind activitatea de metrologie, aprobată cu modificări prin Legea nr. 11/1994, cu modificările şi completările ulterioare, tarife pentru lucrările efectuate de personalul Biroului Român de Metrologie Legală (BRML), în cadrul exercitării controlului metrologic legal al mijloacelor de măsurare şi măsurărilor.

    2. Tarifele sunt cuprinse în tabelele nr. 1 - 3, care fac parte integrantă din prezenta anexă, şi se referă la următoarele activităţi specifice:

    a) lucrări efectuate de BRML în cadrul exercitării controlului metrologic legal al mijloacelor de măsurare prin aprobări de model, verificări metrologice, verificări iniţiale CEE şi avize metrologice (tabelul nr. 1);

    b) activităţi desfăşurate de BRML pentru autorizarea/avizarea persoanelor fizice şi juridice pentru exercitarea activităţilor de verificare metrologică, reparare, montare şi modificare a mijloacelor de măsurare (tabelul nr. 2);

    c) activităţi conexe celor din tabelele nr. 1 şi 2 (tabelul nr. 3).

    3. Lucrările privind activităţile menţionate în tabelele nr. 1 - 3 se efectuează numai pe bază de solicitare scrisă şi cu planificare.

    4. Tarifele stabilite prin prezenta listă sunt scutite de TVA, conform art. 127 alin. (4) din Legea nr. 571/2003 privind Codul fiscal, cu modificările şi completările ulterioare. Fac excepţie tarifele care se referă la verificări metrologice şi asistenţă tehnică.

    5. La tarifele pentru aprobări de model sau completări, precizate în coloanele 3 şi 4 din tabelul nr. 1, se adaugă o parte variabilă încasată pe bază de deviz, reprezentând contravaloarea lucrărilor efectuate de laboratoarele de încercări sau a lucrărilor de evaluare pentru recunoaşterea încercărilor.

    6. Tarifele de verificare metrologică prevăzute în coloana 5 din tabelul nr. 1 se referă la verificarea metrologică individuală a mijloacelor de măsurare. În cazul în care verificarea metrologică sau verificarea iniţială CEE a mai multor mijloace de măsurare se execută simultan, pe instalaţii/standuri de verificare, tariful de verificare metrologică se poate diminua faţă de tariful prevăzut în tabelul nr. 1, până la un procent stabilit de către părţi în cadrul unui contract încheiat în acest sens.

    Tarifele de supraveghere a activităţii desfăşurate de laboratoarele de metrologie autorizate, prevăzute la nr. crt. 1 din tabelul nr. 3, se referă la testarea individuală a mijloacelor de măsurare din eşantioanele reprezentative pentru mijloacele de măsurare verificate metrologic de laboratorul respectiv. În cazul în care testarea mai multor mijloace de măsurare se execută simultan, pe instalaţii/standuri de verificare ale laboratorului supravegheat, tariful de supraveghere a activităţii laboratorului se poate diminua faţă de tariful prevăzut în tabelul nr. 1, până la un procent stabilit de către părţi în cadrul unui contract încheiat în acest sens.

 

    7. Tarifele de verificare precizate în coloana 5 din tabelul nr. 1 nu includ cheltuielile ocazionate de transportul etaloanelor, mijloacelor de măsurare şi personalului verificator, în cazul în care verificările metrologice sau verificările iniţiale CEE se efectuează la sediul solicitantului. Contravaloarea acestora se adaugă la tarifele respective. Pentru autolaboratoare şi mijloace de transport speciale, contravaloarea cheltuielilor de transport se determină astfel:

    - pentru autolaboratoare: 30% din preţul în vigoare la data efectuării transportului al unui litru de carburant, pentru fiecare kilometru parcurs;

    - pentru mijloace de transport speciale (automacara destinată verificării podurilor - basculă, şalupă fluvială): preţul în vigoare la data efectuării transportului al unui litru de carburant, pentru fiecare kilometru parcurs.

    8. Tarifele stabilite prin prezenta listă nu includ contravaloarea materialelor de referinţă (MRC) şi a materialelor consumabile (de exemplu: apa pentru instalaţiile de debit, amestecurile de gaze pentru analizoarele de gaze, energia consumată în instalaţiile de verificare de mare putere, consumul tehnologic de carburant etc.). Costurile acestora se adaugă la tarifele stabilite pentru operaţiunile de verificare respective.

    9. În cazul în care beneficiarul solicită executarea verificării metrologice sau a verificării iniţiale CEE în regim de urgenţă (o perioadă mai mică de 5 zile, care necesită modificarea celorlalte programări sau efectuarea de ore suplimentare), laboratorul de metrologie va percepe un tarif majorat cu 50% faţă de tariful de verificare stabilit prin prezenta listă.

    10. Laboratoarele de metrologie din structura sau din subordinea BRML sunt obligate să efectueze operaţiunile de verificare metrologică sau verificare iniţială CEE, în termen de maximum 30 de zile de la data punerii la dispoziţie a mijloacelor de măsurare, dacă beneficiarii respectă termenele stabilite prin programarea la verificare metrologică.

    11. Beneficiarii trebuie să ridice de la sediul laboratorului de metrologie mijloacele de măsurare verificate, în termen de 15 zile de la data stabilită pentru ridicarea acestora. După expirarea acestei perioade, beneficiarii vor plăti, pentru fiecare zi de depăşire, o penalizare de 0,1% din valoarea tarifului de verificare a mijlocului de măsurare neridicat.

    12. Tarifele pentru reevaluarea activităţilor desfăşurate de deţinătorii de autorizaţii/avize se obţin prin însumarea a 50% din tariful perceput la autorizare/avizare şi 50% din tariful perceput pentru fiecare extindere acordată.

    13. Tarifele pentru autorizare/avizare şi pentru extinderea autorizării/avizării cuprinse în tabelul nr. 2 nu includ cheltuielile de transport şi cazare ale echipei de evaluare, contravaloarea acestora adăugându-se la tarifele stabilite pentru activităţile de autorizare/avizare respective.

    14. În cazul în care operatorii economici solicită laboratoarelor de metrologie din structura sau din subordinea BRML verificarea unor mijloace de măsurare în scopul scoaterii lor din funcţiune (pentru aplicarea prevederilor art. 21 şi 23 din Legea nr. 15/1994 privind amortizarea capitalului imobilizat în active corporale şi necorporale, republicată, cu modificările ulterioare), tariful perceput pentru operaţiunea executată va reprezenta 50% din valoarea tarifului de verificare a mijloacelor de măsurare respective.

    15. Tarifele stabilite prin prezenta listă sunt exprimate în euro, cu excepţia celor calculate pe bază de deviz, care sunt exprimate în lei. Încasarea contravalorii tarifelor se face în lei, pe baza cursului de schimb valutar euro/leu comunicat de Banca Naţională a României, valabil pentru ultima zi din luna precedentă celei în care se face facturarea.

    NOTE:

    1) Mijloacele de măsurare cuprinse în tabelul nr. 1 corespund sortimentelor din Lista oficială a mijloacelor de măsurare supuse controlului metrologic legal, LO-2004 (LO); în cadrul sortimentelor au fost diferenţiate şi codificate subsortimente caracterizate prin acelaşi tarif de verificare. În cazul mijloacelor de măsurare care se verifică la locul de utilizare, deţinătorii sunt obligaţi să pună la dispoziţie spaţiul necesar (atunci când este cazul), utilajele auxiliare şi personalul ajutător necesar efectuării verificărilor metrologice;

    2) Tarifele prevăzute în coloana 3 se referă la: aprobări de model (AM), aprobări de model CEE (AM-CEE) şi aprobări de model individuale (AMI);

    3) Tarifele prevăzute în coloana 5 se referă la: verificări metrologice iniţiale, verificări iniţiale CEE, verificări metrologice periodice şi verificări metrologice după reparare sau modificare;

    4) La verificarea contoarelor de apă caldă cu apă rece, se aplică tarifele pentru contoarele de apă rece;

    5) În cazul în care în componenţa mijlocului de măsurare (contor static de energie electrică) este inclus un ceasornic programator, la tariful de verificare se adaugă şi tariful de verificare al ceasornicului;

    6) Tariful din coloana 3 se aplică numai pentru contoarele de energie termică pentru apa caldă de consum.
